Bed and Breakfast Permitting<\/h2>\n

Bed and Breakfast facilities must be permitted as lodging facilities under the Sanitary Regulations for Hotels (12VAC5-431\"Leaving<\/a>).<\/span><\/p>\n

Bed & Breakfast facilities are subject to all of the requirements of this regulation, with two exceptions:<\/p>\n

    \n
  1. \n
      \n
    1. Unlike in a hotel or motel, B&B laundry storage rooms do not<\/em> have to be separated from owner living quarters (12VAC5-431-340 \"Leaving<\/a>).<\/li>\n
    2. B&Bs are not<\/em> required to have a three-compartment sink or commercial dish-washing machine \u00a0for the washing of any glassware provided in patron rooms <\/em>(12VAC5-431-440 \"Leaving<\/a>).<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n

      Bed and Breakfast Exemptions<\/h2>\n

      Bed & Breakfast facilities are exempt from the requirement for a food establishment permit if:<\/span><\/p>\n

        \n
      1. The premises of the bed-and-breakfast operation is owner occupied or owner-agent occupied;<\/li>\n
      2. \u00a0The bed-and-breakfast operation prepares food for, and offers food only to, individuals who are guests of the bed-and-breakfast ;<\/li>\n
      3. 18 guests or less are served at the bed-and-breakfast operation on any given day; and<\/li>\n
      4. The bed-and-breakfast operation informs guests, in a manner outlined in the Food Regulations (12VAC5-421 \"Leaving<\/a>), that the food is prepared in a kitchen not permitted as a food establishment<\/li>\n<\/ol>\n

        Any meal<\/strong> can be offered to guests, not just breakfast.<\/p>\n
