Migrant Labor Camps are one or more structures next to land used as living quarters for migrant worker(s) engaged in agricultural or fishing activities, including related food processing. <\/span><\/p>\n

A Migrant Labor Camp does not include:<\/span><\/p>\n

(i) a summer camp, campground or hotel as defined in \u00a7 <\/span>35.1-1<\/span><\/a> of the Code of Virginia.<\/span><\/p>\n

(ii) housing that is regularly offered to the general public on a commercial basis and is provided to any migrant worker on the same or comparable terms and conditions.<\/span><\/p>\n

(iii) small businesses that are exempt under federal law as provided in the Fair Labor Standards Act (29 USC \u00a7 201 et seq.) and the Migrant and Seasonal Worker Protection Act (29 USC \u00a7 1801 et seq.). <\/span><\/p>\n

The agricultural industry employs many migrant farm workers in the planting, cultivating, harvesting, and packaging of the crops grown <\/span>throughout<\/span> the Commonwealth of Virginia. The Virginia Department of Health enforces regulations to ensure the safe and healthy living conditions of migrant workers during their employment in Virginia.<\/span><\/p>\n
