The process to obtain a permit starts with a commercial plan review before construction begins.<\/p>\n<p><span style=\"color: #000080;\"><strong>Food facilities catering from a shared commissary kitchen<\/strong><\/span><strong><br \/>\n<\/strong>If a food facility plans to cater from a shared, commissary kitchen, both the commissary kitchen and the caterer will need to apply for separate permits.\u00a0 See <a href=\"https:\/\/www.vdh.virginia.gov\/content\/uploads\/sites\/196\/2024\/04\/Guidelines.Shared.Incubatyor.Kitchens.acc_updated_2017-1.pdf\"><span style=\"text-decoration: underline;\"><span style=\"color: #0000ff; text-decoration: underline;\">Incubator Kitchen Guidelines<\/span><\/span><\/a> when sharing a kitchen space with another permitted operator.\u00a0 It is recommended that the commissary kitchen operator contact the Food EHS in the locality where the commissary will be based to schedule a pre-application consultation.<\/p>\n<p>All caterers wishing to operate in a permitted commissary kitchen will need to obtain their own food establishment permit by submitting an <span style=\"color: #0000ff;\"><a href=\"https:\/\/www.vdh.virginia.gov\/content\/uploads\/sites\/196\/Fillable-AnnualPermitApp.Stationary-Foodservice-Facility-Mobile-or-Pushcart-Units-Caterer-Application-1-508c.pdf\"><span style=\"text-decoration: underline;\"><span style=\"color: #0000ff; text-decoration: underline;\">Application for Foodservice Establishment Permit<\/span><\/span><\/a><span style=\"color: #000000;\">. <\/span><\/span><span style=\"color: #000000;\">For specific requirements\u00a0s<\/span><span style=\"color: #0000ff;\"><span style=\"color: #000000;\">ee <\/span><a href=\"https:\/\/www.vdh.virginia.gov\/content\/uploads\/sites\/196\/CATERING.Guidelines.Final_.7.24.24._508c.pdf\"><span style=\"text-decoration: underline;\"><span style=\"color: #0000ff; text-decoration: underline;\">Catering Guidelines<\/span><\/span><\/a> <span style=\"color: #000000;\">for specific requirements.<\/span><\/span><\/p>\n<p><strong><span style=\"color: #000080;\">STEP 1:<\/span> Before Construction Begins<\/strong><\/p>\n<p>Whenever a food establishment is constructed or remodeled or <span style=\"color: #000000;\">whenever<\/span> an existing structure is converted to use as a food establishment, plans and specifications for such construction, remodeling or conversion must be submitted prior to the start of such construction, remodeling or conversion. The owner will have the final responsibility for the accuracy and completeness of the plans and specifications, as well as for subsequent construction and installation.\u00a0 For guidance on sizing and specifications see the <a href=\"https:\/\/drive.google.com\/file\/d\/1I8a_fZfuhnPS-KfScvbB6QBzLvol1NqS\/view\"><span style=\"text-decoration: underline;\"><span style=\"color: #0000ff; text-decoration: underline;\">FDA Food Establishment Plan Review Guide<\/span><\/span><\/a><span style=\"color: #000000;\">.<\/span><\/p>\n<p><strong>Note:<\/strong>\u00a0Construction of the food establishment cannot begin until the Health Department has completed its commercial plan review process.\u00a0\u00a0 All applications are to be submitted to the local Environmental Health office where your business will be based will based in Louisa, Nelson, Fluvanna or Greene Counties. (Include map of BRHD with localities)<\/p>\n<p>Follow these steps to start the process:<\/p>\n<ol>\n<li>Initiate a building permit application with\u00a0local Building Official where the business will be based.<\/li>\n<li>Make application for a business license in the locality or city where your business will be located.<\/li>\n<li>Complete a <a href=\"https:\/\/www.vdh.virginia.gov\/content\/uploads\/sites\/196\/Fillable-Foodservice_Plan-ReviewApplication_2021_508c.pdf\"><span style=\"text-decoration: underline;\"><span style=\"color: #0000ff; text-decoration: underline;\"><span style=\"color: #0000ff; text-decoration: underline;\">Plan Review Application<\/span><\/span><\/span><\/a> and an <a href=\"https:\/\/www.vdh.virginia.gov\/content\/uploads\/sites\/196\/Fillable-AnnualPermitApp.Stationary-Foodservice-Facility-Mobile-or-Pushcart-Units-Caterer-Application-1-508c.pdf\"><span style=\"color: #0000ff;\"><span style=\"text-decoration: underline;\">A<\/span><span style=\"text-decoration: underline;\">pplication for Foodservice Establishment Permit<\/span><\/span><\/a> and submit to the Environmental Health Office in the locality where the facility will be located. Application fee: $80.<\/li>\n<li>Per the\u00a0<em>Virginia Food Regulations<\/em>, owner of record must apply at least 30 days prior to opening to the public or start of renovation.<\/li>\n<\/ol>\n<p>Plan Review Documents to Submit Along with your Application:<\/p>\n<ul>\n<li>Plans, a.k.a. \u201cdrawings,\u201d shall be provided to the Health Department by any person intending to construct, remodel, obtain a new Virginia Department of Health Permit to Operate a Foodservice Establishment.<\/li>\n<li>Applicant must submit plans to the Health Department for review and approval plus\u00a0<strong>a plan review fee of $40.00 for each vehicle or trailer.<\/strong><\/li>\n<li>Plans must be drawn to scale (e.g., 1\/4\u2033 = 1 ft.) on 8 1\/2 x 11 inches or larger white paper with dark ink only, blue prints or any other standard floor plans. The plans must show top schematic view of foodservice equipment layout, listing of all proposed equipment types and model numbers.<\/li>\n<li>Specification sheets for all foodservice equipment.<\/li>\n<li>Overall site plan including location of business in building, location of site on street(s), any outside equipment such as dumpsters, waste oil containers, septic systems, wells, etc. (if applicable)<\/li>\n<li>Proposed menu including seasonal, off-site catered items as well as any sample menus to be offered to guests.<\/li>\n<li>Projected number of meals per day to be prepared in the facility.<\/li>\n<\/ul>\n<p><strong><span style=\"color: #333399;\">STEP 2:<\/span> Plan Review Approval Letter Sent<br \/>\n<\/strong>Once the department has reviewed all the documentation submitted, a letter will be sent to the applicant outlining any changes that will need to be made to the initial application and will note that the application has been approved for construction.<\/p>\n<p><strong><span style=\"color: #000080;\">STEP 3:\u00a0<\/span> Send a written reply to the EHS who sent you the above letter<\/strong><br \/>\nState how you will comply with any changes noted or submit the requested specifications or other documentation.\u00a0 If changes are made, you may need to submit corrected drawings or reference the ones you have already submitted.<\/p>\n<p><span style=\"color: #000080;\"><strong>STEP 4:\u00a0<\/strong>\u00a0<\/span>Once construction is completed and the equipment is in place, contact the Environmental Health Specialist who sent you the Plan Review Approval Letter to schedule a pre-opening inspection. Please call at least 3 days before the day you would like the inspection to take place. The following requirements must be met for approval of the pre-occupancy inspection:<\/p>\n<ul>\n<li>Document showing Occupancy Permit has been issued by the Local Building Official must be available.<\/li>\n<li><span style=\"color: #000000;\">The person in<\/span> charge at the time of the inspection must show a current <span style=\"text-decoration: underline; color: #0000ff;\"><a style=\"color: #0000ff; text-decoration: underline;\" href=\"https:\/\/www.vdh.virginia.gov\/blue-ridge\/certified-food-manager-guidelines\/\"><span style=\"color: #0000ff; text-decoration: underline;\">Food Safety Manager Certification<\/span><\/a><\/span> for at least one employee with supervisory and management responsibilities and the authority to direct and control food preparation and service.<\/li>\n<li>Refrigerators must be set to ensure the food is maintained at 41\u00b0F or lower and in freezers at 0\u00b0F or\u00a0lower with working thermometers in each\u00a0unit.<\/li>\n<li>Facility must be clean with no construction material in kitchen and related areas.<\/li>\n<li>No food can be served to the public prior to the pre-opening inspection and approval by the Health Department permit has been issued.<\/li>\n<li>A final menu must be provided. Please note that all the steps listed above are required before an EHS can conduct the pre-opening Inspection. Learn what to expect during a food inspection.<\/li>\n<li><span style=\"text-decoration: underline; color: #0000ff;\"><a style=\"color: #0000ff; text-decoration: underline;\" href=\"https:\/\/www.vdh.virginia.gov\/blue-ridge\/what-to-expect-from-a-food-inspection\/\">What to expect during a food inspection<\/a><\/span><\/li>\n<\/ul>\n<p><strong><span style=\"color: #000080;\">STEP 5:<\/span> Open for Business<\/strong><\/p>\n<p>Upon completing a successful pre-opening inspection, the Health Department will issue a permit to operate.
